25-Aug-2023 (In Civil Law)
I published the advt. regarding sale of my car in TOI. The buyer of the car has to give me money and 15 old stamps. Mr sharma was interested in buying the car. I got into written agreement for the sale and delivery of car with Mr Sharma. He orally promise me that he will give me 15 old stamps after the delivery of car. I delivered the car to him but he didnt gave me the 15 old stamps Could I sue him??

Yes you can sue him as per the Agreement, legal notice needs to be sent initially in our stern legal language on the letter head of our law firm. If he does not agree to our demands raised in the Legal Notice, we can sue him thereafter.

Oral agreements are binding on parties. The only difficulty with said agreements is to prove before court that any such assertion was made by the other side. You can still go ahead and file a suit for specific performance.

Old stamps were for what purpose??Were these terms and conditions incorporated in your agreement. If yes then you can ask him for specific performance of the same or else you can go ahead and seek damages for any inconvenience caused to you.But depends what these stamps were for what purpose disclose the complete facts i mean you can not sue anyone over petty issues.
