Yes. Keeping your Savings Account on hold for 5 years due to a Credit Card issue is legally questionable, and in many cases unlawful, especially when both are separate financial products. I will explain this clearly and briefly, then tell you what legal action actually works. Why the Bank’s Action Is Wrong Savings Account and Credit Card are separate contracts A bank cannot indefinitely freeze or refuse closure of a savings account merely because a credit card is pending, unless there is a court order or statutory attachment. No automatic “right of lien” for credit cards General lien under Section 171 of the Indian Contract Act does not apply automatically to credit card dues Especially after 5 years, this becomes harassment and unfair trade practice RBI Master Directions violated Banks are required to: Allow account closure on customer request Not impose arbitrary restrictions Not hold funds without legal authority Five years = unreasonable & oppressive conduct Even if dues existed earlier, the bank must: Either recover through legal process, or Release the savings account They cannot hold your account hostage indefinitely. What Actually Works Against Banks (Practically) This issue is not solved by arguments at branch level. It requires legal escalation in the correct order. Step 1: Legal Notice to Bank (Effective) A properly drafted legal notice should demand: Immediate closure of savings account Release of funds Written justification with legal authority Compensation for mental harassment Most banks act within 15 days after a serious legal notice. Step 2: RBI Banking Ombudsman Complaint If the bank still refuses: Complaint under RBI Ombudsman Scheme, 2021 This is online, document-based, and banks take it very seriously Step 3: Consumer Court (If Needed) Deficiency of service Unfair trade practice Claim for compensation Banks do not want consumer cases on record. Important Warning (Do Not Ignore This) If you delay further: Bank may later wrongfully adjust funds Or falsely claim customer consent Or quietly mark internal recovery actions Handling this incorrectly can weaken your position. How I Can Help You I can: Examine whether the bank has any lawful lien or authority Send a strong, RBI-compliant legal notice File and pursue Ombudsman complaint entirely online Get your savings account closed and funds released Seek compensation for harassment if warranted You do not need to visit any office or court for this. If you want this resolved properly, this is not a matter to handle casually, because banks rely on customers giving up. You may contact me for a short paid consultation so I can take this forward in the correct legal manner and close this issue permanently.

A bank cannot indefinitely refuse to close a savings account merely because a credit card account is on hold or disputed. A savings account and a credit card are separate financial products, and unless there is a specific contractual lien or court order, the bank has no automatic right to block account closure for 5 years. Legal remedies available: Written representation to the Bank: Submit a written request seeking closure and ask the bank to provide the specific rule/contractual clause under which the account is being held. Grievance to Bank’s Grievance Cell & RBI CMS: If unresolved within 30 days, file a complaint with the RBI – Complaint Management System (CMS). RBI guidelines require banks to resolve.

A bank cannot indefinitely freeze or refuse to close a savings account merely due to a pending or defaulted credit card liability, especially when both are separate financial products. As per RBI guidelines and settled banking principles, lien or set-off can be exercised only after due notice and within reasonable limits. A 5-year hold is excessive and arbitrary. You may first submit a written request to the bank seeking closure and reasons for continued hold. If unresolved, you can issue a legal notice alleging deficiency in service and unfair banking practice. Thereafter, a complaint can be filed before the Banking Ombudsman under RBI Integrated Ombudsman Scheme, 2021, or before the Consumer Commission seeking account closure and compensation for harassment. Courts have consistently held that banks must act reasonably and proportionately.
