How to obtain child custody certificate from Indian Court

• My friend died in Kuwait and his wife with 3 minor kids (8, 10 & 15 yrs) moved back to India. • Wife gave Power of Attorney to her brother in Kuwait to collect some small amount in Kuwait bank. • He also gave a Certificate from Revenue dept indicating the father of the deceased, wife of deceased and 3 minor kids (with age 8, 10 and 15 yrs) of the deceases as inheritors. • The Bank now wants to make sure that the Children are with the Mother as claimed by her in her POA and so asking for Children Custody Certificate from the Indian Court. • What is the procedure to get such a Certificate from Indian Court? • There is no dispute from any family member.

Indian courts are issue succession certificate or and also revenue department issues legal heir certificates. so your friend wife will approach district court where she is originally resides for succession certificate to submits banks.case will file against the bank.cont advocate

Your friend's wife has to file a suit for declaration suit that her children with her and declare them as the legal heirs and the Order of the court passes order declaring that the children are living with her mother, then with the said order you can claim the amounts.
