Custody of my child is 1year 1 month old

Can I get a custody of my child as she is minor, and want a divorce from my husband, he gets really irritated with small things, and doesn't respect me even slapped me and he once took out a rod to but not hit me. Narrow minded man and his family to. But he doesn't want to give me divorce?
