Child custody with or without divorce

I am a Hindi..I don’t want to live with my husband and bring up my child alone. After 3 months I always Pregnent my husband sent me to India as he working Australia..After delivery I had serious health issue he just came to see the child as it was a boy..he is just in touch to see his kid in video call..he drinks a lot and also aborted my 1st child forcefully..if he files case for child custody what will happen..will I loose my child to him ?
madam need not worry about it the custody of the children will be with Mom you have not mentioned about about wat relief you need from court like divorce or maintenance so plz mentioned wat advice or relief you need

in this case as the child is with you from birth and as you are looking after his welfare, further he is drinker, moreover he is in Australia he cannot get the custody, further if he wants the custody he has to come to India and file case where the child is residing and even after filing the case it will not be possible for him to get custody. it is better you file a case for divorce and claim permanent aliomny and maintenance for your child.
