What to do a case has been filed under section 138 of NI act

legal notice sent on 25.9.2012 delivered to party and ad card received back on 4.10.2018 case filed on 21.11.2012 stating that Ad card not received but only at the time of evidence ad card was produced saying that it was misplaced
cause of action to file the case starts from the 16th day from the date of receipt of the legal notice.evidence can be adduced in a case at any time.here in your case the ad card was produced at the time of evidence and the same is not an irregularity.
