What is the time limit to issue a notice

Cheque returned memo date is 31/12/2013 notice issued on 30/01/2014. Pls give suggestion is it 30days limit or not.

Hi
1) Cheque return memo is dated 31-12-2013. Next business day is 01-01-2014.

2) Notice should be sent by registered post on 30-01-2014. (30 days including 01-01-2014)

For the purposes of limitation, in so far as legal notice is concerned, it is to be served within 30 days of the receipt of information by the drawee from the bank regarding the return of the cheque as unpaid. Therefore, after the cheque is returned unpaid, notice has to be issued within 30 days of the receipt of information in this behalf.

The time period is exactly thirty days from the date of receipt of cheque return memo from the bank. Therefore, it is within the time limit to issue cheque bounce notice to the defaulter of the cheque.

if the notice is posted within 30 days from the date of knowledge of the return of the cheque that is said to be within in time so the date of memo is irrelevant but the knowledge of the fact that the return of memo is relevant
