First send him legal notice within 30 days from the date of cheque is bounce and in that notice giV him 15 days time to pay back your money.
And if 30 days period is over and you have not send him notice then again present the cheque in bank and when that cheque bounce send him notice. Notice should be sent through registered post with acknowledgement. And now after receiving notice he does not pay your money within 15 days than present complaint under sec 138 N.I Act before magistrate within 30 days

You have to send legal notice within 30 days from the date of check bounce giving him 15 days time to give the money back or face legal action under NI ACT and thereafter you can file case within 30 days from the receipt of notice to accused.
