Law on cheque bounce cases - After cheque has bounced, you must approach a lawyer, and you need to send a Demand Notice within 30 days from the day of intimation by bank, of cheque being bounced, to the person who has given you cheque. The notice must give him time of 15 days to pay up the cheque amount, and if he does not pay up within 15 days, then from the day of expiry of 15 days mentioned in demand notice, within 30 days file complaint before the court. You must note that time lines are very important for filing a criminal complaint under section 138 NI Act. In the event you miss the timelines, for any reason, you can still file suit for recovery under order 37 or otherwise, However in such an event you may have to pay court fee on the amount to be recovered.

Dear Sir/Madam,

After the bouncing of cheque contact your lawyer with the cheque and return memo of bank to sent a legal notice to the other party and thereafter you can file a suit in case he or she fails to comply with your notice.
