I am from haryana. I default a loan because of job loss. Accident. I have multiple loans and I lost all money in a online fraud. Now I got a summon from calcutta court to appear. But it is not possible for me to go there. Because my wife is pregnt and delivery is in next mnth and appearing date is 11.11.25. I have no money even for my daily needs and for my wifs delivery. How I will go and I have no money to settle loan. I need time upto 1 year to settle the things. Please help to resolve this. I can't go and have no money .

Hello, You can have an Advocate appear on your behalf before the Magistrate and you don't need to come immediately. That's the one solution which can be given to you keeping in mind that your wife is pregnant.

If you don’t appear in court, a warrant may be issued. So, immediately file an exemption petition through a Kolkata-based lawyer, mentioning that you cannot attend due to your wife’s pregnancy and financial hardship. Attach her medical certificate for proof. Your lawyer can appear on your behalf and request time for settlement. This will prevent any arrest warrant from being issued.
