Understand The Benefits Of NI Act as Compared To Summary Suit

I have been cheated and have got agreement papers with 2 post dated cheques which have also been bounced, post that I have filed a NI Act Section 138 case before the district court but now slowly I am hearing that the case might take 5-6 years to be disposed off. So I wanted to understand if Summary Suit can be filed simultaneously and whether it would be beneficial or not. Thanks in advance!

hello this is Monima Khan, Advocate. I have been practicing since 2004. Answering your questions yes you can but why does your NI case will take 5-6 years to dispose off?? See NI act matter are supposed to hear separately and faster and that's why separate act has been passed. I guess your strategy might not be stronger.

Dear client, you cannot file another case for same cause of action. The thing you can do is get an order from High Court for expeditious trial. This order would help you dispose the case by speedy trial.
