to change writing statement in front of judge

Sir, I gave contract of installation of 100HP transformer and other to a mseb authorised private electric contractor for Rs 6 lac in my ice factory. After completion of the work I gave him final amount RS. 110000/- post dated cheque. the cheque bounced and he sued me 138 NI case. I agreed in front of the judge giving writing statement to pay him in instalment and paid him first instalment of 15000/-in front of judge. But after that I came to know that he has cheated me by installing 63HP transformer instead of 100HP. The payment of 100HP transformer is done by RTGS from my account. Now I don't want to pay him further instalments as I came to know that the electric crises in my factory was due to that and it causes losses to me like burning of motors frequently etc. I am bound to pay him as I have given writing statement in front of judge. Sir, is there any procedure to change my statement in front of judge and not to pay him and prosecute the case as to teach him a lesson for fraud.
You should now immediately register a police complaint under section 155 of CrPC for cheating under section 420 of IPC, or you can file a complaint in the office of Chief Judicial Magisterate under section 190 of CrPC. Also, you can file a complaint in the consumer court against the said contractor. He will be prosecuted for cheating by fraudulently letting you believe that the transformer was of 100HP instead of 63Hp.

Apart from that you have an right to file 420 on him and also an private complaint u/s 320 of cr.p.c.
