Hi I have check bounce case against me need some clarification on the time frame can anyone please explain if the complainant has followed the time limit prescribed under the rules.
Check return Memo date - 11-02-2018
Legal notice dated - 01-03-2018
PCR filing date- 18-04-2018 @1.16 pm
Its approximately 65 to 67 days from the date on which the complainant received the memo from the bank will this be counted as delayed in filing case
Dear Sir,
After giving notice you need to file a complaint case against drawer within Thirty days from the expiry of notice period that is fifteen days. In other words you need to file complaint case against drawer within fourty five days from the date of issue of notice. Failure to do so will lead to loss of remedy however you can file a summary suit for recovery of money and initiate criminal proceedings within three years from date of issue of cheque
