Suggestion in case of cheque bounce and further proceedings.

Hi sir I'm take by loan 4000rs/. Private person in 2015/may he as put my bike and blank cheque with rate of 7% intrest . He as return bond paper 40k . I'm not pay loan amount he as put msg I'm sold u r bike . Then after 1 year he as deposit cheque he as write 1 lakh rs, but right now I'm not receive any cheque bounce legal notice . But one person calling to me u r check bounced I'm calling form ps . What I'm doing its possible are face. My bank account address is this rent address, and my rc details permanent address, my phone number stilte working .

Dear,

As you are saying that you have received a call from the PS and if indeed somebody has called you from the PS, I presume that the person to whom you have issued a cheque has filed a complaint against you for cheating and the police has called you for talks OR it could be that somebody from outside has made a fake call in order to put pressure on you. If the call was indeed from the PS, don't worry even if the police registers an FIR, they cannot arrest you automatically as they have to send you a notice seeking your presence before them to record your statement. After receipt of the notice, you can seek anticipatory bail from sessions court.

Now, inquire with your bank to find out if the cheque that you have issued is bounced or not. If yes, then wait for the person to whom you have issued the cheque to send you a demand notice and then reply to that notice within 15 days of receipt of the notice. If the person files cheque bounce case against you after that, the court will send you summons for you to appear before the court. Collect the summons, engage a cheque bounce lawyer and contest the case.

Your creditor is not entitled to transfer/sell your vehicle. Give suitable reply through your counsel if he send legal notice u/Sec138 of NI Act. Without complaint the concerned police will not call you. Ask the caller from which PS he is calling and approach the PS with a lawyer and enquire the matter.
