Should i submit all the details to amicus curies appointed by SC
03-Jul-2023 (In Cheque Bounce Law)
I have filed check bounce case against Unitech in Saket court. In newspapers SC has appointed amicus curie n it is written all home buyers to submit to amicus. With check bounce case going Can I submit all details to amicus also.
The amicus is suppose to assist the court . I would advise you to get in touch with the amicus and understand their requirement. There is non harm in submitting the details to the amicus as the complaint under section 138 has already been filed.
Yes, you can submit the details to Amicus Curiae. As it is not a party to a case, but volunteers to offer information on a point of law or some other aspect of the case to assist the court in deciding a matter before it. The decision whether to admit the information lies with the discretion of the court. Amicus parties try to “help” the court reach its decision by offering facts, analysis, or perspective that the parties to the case have not. An amicus curiae brief is a persuasive legal document filed by a person or entity in a case, usually while the case is on appeal, in which it is not a party but has an interest in the outcome.
SC had appointed Mr Pawanshree Agrawal as amicus to enable Unitech buyers to excersise option for refund or possession of flat .But there was some last date for giving options .With your case pending ,you can give the option ,but will have to check whether the last date for giving options is over or still it is allowed to be given
