Security cheque presented by bank against loan default
04-Oct-2024 (In Cheque Bounce Law)
Bank presented a undated security cheque after very long time and cheques were stopped long back, what to do now, bank put current date and presented acct is also dormant for couple of years, does it still be a cheque bouncing case amt bounced is more then what is due to bank as on date
If a bank presents an undated security cheque from a dormant account and it bounces, it can still lead to a case under Section 138 of the Negotiable Instruments Act. However, you can challenge this based on the cheque being undated, the account being dormant, and the amount exceeding your current dues. It's essential to contest the misuse of the cheque, especially if it was presented after an unreasonable delay.
