Rs 10 Lac Cheque Bounce and now what to do?

I have done work for Someone and later he had given me a cheque of 10 lac and that cheque dishonoured ( Bounce). Now where have to file a case and how much time it will take time to recover?

Upon dishonour of cheque within 30 days the drawer must be sent legal and demand notice. If he fails to give the money, within 30 days complaint should be filed in the court where you reside or where the cheque was dishonoured. The law says within 6 months these cases must be decided, but generally it takes more than that due to number of pending cases.

Things needs to be done within time failing which things may get difficult.

The moment you file the case and when the respondent/accuses/drawer comes to the court will be either sent to jail or shall pay your money either in part or full or may negotiate with you.

Before proceeding with filing a case, it is necessary to send a legal notice to the accused party. If the accused fails to pay the owed amount within 15 days from the date of receiving the notice, then we can initiate legal action by filing a case in the District Court within the respective district. time period about one year

you can file case where you bank is suited and generally it may takes more than 1 year. it also depends the other party when they are ready to settle the matter. you need to send notice with in 30 days of cheque bounce.

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit/cheque bounce in the court to claim your money back along with compensations.

You need to initiate legal action promptly for recovery of your money. Do engage a lawyer and seek advise. Please note there is a strict time lines for taking action under section 138 of the Negotiable Instruments Act so do act promptly. Need to issue a legal Notice followed by a complaint under section 138.
