i received the check of 122000 from adyas venture banglore.it is bounce now and he told to represt me it again then also it got bounce.now i want to do the legal action on him. what i the procedure

Hi, you have to send statutory demand notice within 30 days calling them to repay the amount covered under the cheque within 15 days from the date of receipt of the notice, if they failed to repay within that time then you have to file a cheque bounce case against them before the jurisdictional court..

Once cheque bounce you have to give legal notice though Advocate for demanding money. After issuing legal notice also if he has not complying his lawyalibity then you can file case under section 138 of NI act

As per Negotiable Instruments Act,1881( Amendment)Act,2015, you have to sent a legal notice in writing demanding for the payment of the said amount of money to the drawer of the cheque (within thirty days) of the receipt of information by him from the bank regarding the return of the cheque as unpaid as u/s 138(b) NI Act.

Within 15 days of intimation of bounce you have to issue legal notice there after you have to file private complaint in the court of magistrate. Approach any advocate and do the needful. You may also lodge police complaint.
