Real estate promoter gave cheque...it bounced....

I have invested 2 lakhs in real estate business person....he gave receipt and cheque, agreement. Actually it's a return amount scheme...I have invested 2 lakhs..he has to return 10000 per month for 12 month at end of 13th month he will return 2 lakh 30000 rupees...this is the agreement. Initially he gave 10000 rupees for 3 month then he stopped the amount..he said that his real estate business was collapsed...the cheque was bounced....ow am planning to file cheque bounce case against him... kindly help me

1. With in 30 days from receipt of the information from the your bank about the dishonour of cheque, send a legal notice though a Advocate demanding payment of cheque amount with in 15 days.
2. On expiry of above 15 days, with in 30 days file a cheque bounce case before the court.
3. you can file a criminal case for cheating against the defaulter.

it has become a common tactics for the touts to use real estate banner to swindle money from unsuspecting investors. I would highly urge you to get in touch with the lawyer who can help you understand the current situation with the available people work in your hand and suggest you the plan of action. in my view I would recommend 138 Nia act case on the bounced cheque, and also a criminal complaint to the police station of your jurisdiction and book the culprit under section 415 of Indian penal code. this is a very serious offence and if he or his family members have the means to settle the amount you are at luck. do get in touch with me if you need any further information.
