Procedure to take action in case of cheque bounce

If cheque bounce what is the procedure to take action on that person who gives me the cheque?

you have the right to take action against the person who issued the cheque to you knowing deliberately to dishonour the cheque and to cheat you.
therefore, the time you are left with is 1 month from the date of the cheque , and when you have presented the cheque and dishonored, approach a lawyer and discuss the details of the cheque.
you have the right to claim the amount from the cheque. its a criminal proceeding.
cause a legal notice to the accused through your lawyer and file a complaint against him under sec 138 Negotiable Instruments ACt.

a notice has to be sent u/s 138 of NIA act and further proceedings to be initiated against the accused under criminal court. the further process will be taken by the criminal court and imprisonment is possible.

Within 30 days from the receipt of information regarding cheque dishonour, send a legal notice seeking payment within 15 days. If the money is not paid within 15 days, you can file a cheque bounce case with 30 days before the court.
