Procedure to file case for cheque bounce and fraud

 I bring your kind notice about a person  saying that he will give the jobs and collected money from me about Rs 38000 in 2015 but he never gives the job to me but in the 2017 of August 11th he was given cheque to me but he did not mentioned my name and date he told me where the cheque in bank but the cheque was bounce how I can file a case on him

your presented bank place is jurisdiction or drawer cheque bank place.you r consult your advocate. filed ni act case against accused.ur bank issued return memo u issued statutory notice to the accused.

This is suggestion only you file a cheque bounce case where the jurdustiction of court and where consult your advocate mentioned the above true facts before your complaint and file the before Honble jurdustiction of court ,the court issue the summons and to secure the accused/brrower and case process proceeded before the court of law

Send a legal notice to the opposite party through a lawyer within 30 days from the date of memo accompanying the bounced cheque is received from the bank and give the opposite party 15 days to settle the matter. The opposite party has 15 days from the receipt of the notice to settle the matter and no cause of action arises till the expiry of these 15 days or if paid within this specified period. After completion of 15 days, if the opposite party does not settle the matter or ignores the notice, then you may file a cheque bounce case before the appropriate court within 30 days of the expiry of said 15 days. If it is beyond 30 days period, the delay can be ignored by the court on sufficient cause being shown. Feel free to contact me if you need any help in this case.
