Procedure of cheque bounce when company is insolvent

cheque issued by ltd company pending criminal complaint u/s 138 company was ordered to be wound up now can the proceeding against a non existing company be proceed and who will represent the company once it is oedered to be wound up

The CEO of the company will have to respond to the allegations even after winding up of the company regarding 138 case if the cheque was so issued by any of the authorities in the computing it's functioning.

You have to send a demand notice through Advocate to the company and if the company fail to respond then you can file a criminal complaint under section 138 of NI Act and then you can recover your money from the company with due procedure of law and the company if it is under winding petition then official liquidator may represent the company
