Person refusing to pay but has issued a cheque

One person took 5 lac rupees from my father in 2010 and gave an undated cheque. My father died in 2011. Since then he has been assuring to return the money but now refusing. My mother is not alive. What action can I take ?
That cheque which was given in the year of 2011 has now become invalid. Moreover you are not the payee of the cheque as such you don't have any locus to file a case or to send demand notice. Suit for recovery of money is also barred by Limitation after the expiry of 3 years.
You try to lodge a FIR. That is the only solution.

after gone through your fact of case, it is clear that that person took of rupees five lacks from your father in the year 2010 but for what purpose?
that cheque is updated or not as per the RBI guidelines?
why u stated your mother is not alive, how your mother is connected or involved in aforesaid fact?
so after see your cheque then I will suggest you and will built up case in favour you.
