Cheque has been Bounced. Bank sent a letter. What is the time period for Cheque Bounce notice in Cuttack.
Section 138 B of the Negotiable Instrument Act provides the provision for Demand Notice
b) the payee or the holder in due course of the cheque, as the case may be, makes a demand for the payment of the said amount of money by giving a notice in writing, to the drawer of the cheque, 20 [within thirty days] of the receipt of information by him from the bank regarding the return of the cheque as unpaid;
So in view of the mandate of Section 138 B of NI Act you have to send a demand notice to the payer of the cheque within 30 days from from the date of receipt of the information from the Bank.
Demand Notice within 30 days is mandatory so without wasting time send a demand notice as soon as possible.
