Need to file Cheque bounce case

One of the company(Free gifts and holiday package) cheated us and we asked for our money back. they are giving checks for us, if we go and asks in their respective banks they said that there is no balance in this account. we are suffering from last 1.5 year. Please guide us to proceed further. recently(10 days back) they are given one more cheque in that also no balance. currently that cheque is with me only .

The procedure is as follows:
1) First present the cheque in your bank.
2) Issue legal notice within 15 days of cheque bounce.
3) File a cheque bounce case u/s 138 and 142 of negotiable instruments act within 30 days from the date of your legal notice.
4) if you have the promissory note , in addition to cheque bounce you can also file a summary suit for recovery of money.
