NBFC's/Banks Cheque Bounce & EMI Issues

We have currently sales down, due to this we have issues to clear EMI's taken from Banks/NBFC's due to which they presented cheque bounce cases under section 138.

first of all ,ask clearly as you posted incomplete question . Bank filed against you that means they have taken check signed by you . you will get summon under section 138 negotiable instrument act. You have to mark your presence in the court after receiving the summons.

hello if cheque bounce case is registered either you will have to contest it or compound it on the court, but to resolve issue you can take help of lawyer to negotiate bank with one time settlement (OTS) otherwise bank/ NBFC has right to recover through DRT or proceeding under SARFESAI act

Hi ,the offence under negotiable instrument act is bailable..You can obtain the bail from court by providing a surety ..The offence is compoundable ,and it can be withdrawn once you deposit the cheque amount with the court ..
