liability for cheque bouncing after my resignation from directorship

Dear Sir I was the director and my signed is missued by other director after my resignation from directorship . After 6 months of my resignation , these cheque were dishonured. Wheater i am liable under sec 138 as authorised signatory. Thanks Manish

You are not liable under Section 138 of the Negotiable Instruments Act if those cheques were not issued by you while being the director of the company. Your responsibility for future transactions of the company ends the very day you resigned unless contrary.

It means you have signed the without filling the date. If it is so then this will be only your defense. Because cheque can be presented in only with in 30 days. But as far as litigation is concerned u may accused in case. But if u get legal notice for payment Please reply to that legal notice with help of advocate Who is experienced in such cases. If you were director at the time when the cheque was issued and you were authorised to sign the same the you will also be liable under section 138. If you are made accused in the petition than in your defence you can prove that your signatures were misused or forged. If the cheques were issued after your resignation than you will not be liable. Rest depends on facts and circumstances of the case.

Dear Manish,
As you have resigned from the post of directorship 6 months back so you were not authorized signatory when dishonoured cheques were issued nd ur signatures are forged. With these facts no liability lie against you, and you can make complaint for against them for forging your signature.
