Legal action against Check bounced due to insufficient funds.

Hi, I run a proprietor firm registered in my name in Bangalore. One of my client has delayed the payment for more than 6 months and gave a cheque for the partial payment amount 2L. But the cheque has bounced due to insufficient funds. Is it worth to take a legal action against him for the amount 2L? What could be the court fee and the lawyer fee involved for this? Is is possible to recover the lawyer fee and court fee from the other party?

Dear Sir You gave posed right question. It is not worth in financial terms because you need minimum 3 years if he goes on appeal and it is three tier system. At the most you may get only 2.5L at the end if everything went in your favor. But such proceedings may teach him a lesson. Secondly if you wish interst and advocate fees then you must file parallel civil case.

Previous company issued legal notice for cheque bounce after 3 years But I issued stop payment when I left that company.

The limitation period for issuing legal notice is 30 days from the date of dishonor of the cheque. Therefore, the action is likely to be barred by limitation. However, it makes no difference whether the cheque was dishonored due to insufficiency of funds or stop payment instructions.
