Is cheque memo sufficient to file complaint

If instrument(cheque) or true copy of cheque not exhibited ,Only cheque return memo is exhibited, That is sufficient for complaint U/s 138 of NIAct- Moreover no bank evidence come on record also.
In case of cheque original cheque is mandatory and memo and legal notice of complainant advocate and postial recepit is also necessary..without these document ur complainant is not maintainable. Pls disclose ur full facts,if u have any problem

Hi.
In case cheque has not been Exhibited, you can move an application for additional evidence for exhibiting the same. The cheque is the basic document and has to prove the same as per law. Memo can only prove dishonor part of offence.

Well exibited document shall be a cheque afyer all its a cheque bounce case but that may not be fatal to case in certain cases however generally its no use to file a case without ex the cheque and no memo alone is not sufficient without any other supporting documentation second there might be a way to still exibit cheque depending on ur case and stage of case
