if payment stop by drawer and inspite of duly informed by drawer than
05-Jul-2023 (In Cheque Bounce Law)
3 checque wese given by me to the saler of goods in advance of Rs 300000/-. Goods was send to me by saler and before its reach to me the two cheque became clear and when goods was oped it was found not ok. and then I stop payment of last cheque Rs 100,000/-.and informed to sailer by mail that I stop payment of cheque. but inspiter of that saler present cheque in his bank and its got bounced and he issue notice to me by his counsel and filed a case u/s 138 NI Act. I want to know wheter any releif I can get in this condition or I shall be bound to pay the amount.

As i go through your query you are having specefic releif with you as you duly informed regarding the goods to seller abd than you stop the payment so you are having full defence .

You have to contact your lawyer as u need to give reply to the notice sent by the complainant stating the reason for non payment as there is no legally recoverable debt, further it has to be seen whether u returned the material or not .

Whatever defence you may have that has to be mentioned in your reply to the court. You may state that the cheques were given as security only. You can also file a case for specific performance of the contract to force the person to deliver the correct goods so you can pay the due amount.
