First and primary step is to deposit the cheque in the bank within its validity period of three months. This step is compulsory because no legal action can be taken unless the cheque is presented to the bank. If the cheque is cleared, the money will be credited to your account and the matter ends. However, if the cheque is dishonoured, the bank will issue a cheque return memo mentioning the reason for dishonour. After that, you must send a legal notice through your lawyer to the cheque issuer within 30 days, demanding payment of ₹5,00,000 within 15 days. If the payment is still not made, you can then file a cheque bounce case under Section 138 of the Negotiable Instruments Act.
