i need an advice of section138.i recived summon from HDFC personel

i recieved sumon from court under the act 138 ...i have a personel loan HDFCbank.i already paid balance amount which they montioned in cheque.is it necessary to attend the count?
yes it is necessary to attend the court as hdfc is claiming that you have not paid the amount for which they have instituted criminal proceedings against you if you do not attend the court a non bailable warranty will be issued against you and you will be put behind the bars you have the attend the court

yes. you have to appear before the court and ask court to direct HDFC to withdraw the case as payment has been made by you towards the returned cheque. also you should file proof of payment to court so that court can dismiss the case as compromised
