I am having old cheque signed without date and amount as collateral by the opp party. He got my amount 10 lakhs signing an agreement on 2013. Is it possible to put cheque bounce case section 138? If so 20% amount needs to be deposited by the opp party? Is it possible in Chennai court, i heared only in bangalore cheque bounce will be resolved in 6 months.
there is a high probability that you can file the case after issuing a demand notice with proper explanation. but the 20% as initial payment from the contesting accused is applicable all over India. it is just that few advocates do not force the opposite party to make such payments by filing petition. do get in touch with the lawyer of your choice to discuss the matter in detail.
