How to recover the money in case payee asking not to deposit cheque?
06-Sep-2023 (In Cheque Bounce Law)
Mr X has to pay me Y amount. he has given me a check for it. but he is asking me not to deposit it, saying that it will bounce. But still he is delaying in giving me the money he owes. How should i get the amount back from him. what can i legally do to get the amount.
if the amount is really huge then you deposit it in the bank without consenting from him and then you may send a legal notice to him regarding cheque bounced and he has to pay back. if the amount is really high this is the good idea.
The cheque is valid only for 3 months. Whether there is date filled in cheque? You deposit the cheque for collection and issue a Legal notice. If he doesn't give money after that also u file a case against him in court. R.J.Parthasarathy advocate
You can deposit the cheque given by him. Once the cheque is returned then you can file a criminal case for cheque bouncing. If you continue to wait, he will stop payment of the cheque and thereafter you cannot file a cheque bouncing case. If you are in Chennai you can contact me for any further advice or assistance.
