how to procede legal for non cts cheaque

hello sir . my counsin issued a non cts cheaque.of 3lac dt 31-12-2018 banks are not accepting.how to procede for 138 ni act in this case.

issue of non CTS cheque tantamount to cheating and 138 NI act will not be applicable as cheque was not dishonoured
first issue notice through your lawyer claiming return of money and also notifying him that the cheques issued by him are old , outdated cheques not valid for banking purposes and hence constitute cheating.
if he does not pay, file a cheating case in nearest police station
