Father in law stopped payment of cheque he gave for settlement
09-Sep-2023 (In Cheque Bounce Law)
My father-in-law gave post dated cheques of settle amount for me and my 1-year-old son, due to death of my husband. on date, I deposited that cheque but cheque was returned mentioned stop payment because of this I file a case on court. But now he file a case in police station they threaten and got that cheque they got crime no for that case. I don't know what further step will take.
it is purely civil nature, the notice shall be sent to the father in law for his act. the court of family or subordinate shall be made. the cheque bounce case shall be made against the father in law or ep shall be filed
There’s already a case against your Father in law u/s 138 . Therefore don’t worry about the police complaint.. the burden of proof lies in him to prove the cheque was taken by you under coercion.
Pursue the case as against him .. the police if they call you for enquiry, just inform them that you are not prepared to come to any police station and there’s already a case pending u/s138 NIAct against your Father in law.
