False cheque bounce case filed by girl how to prove her wrong
12-Sep-2023 (In Cheque Bounce Law)
A girl has filed a case against the firm , where she never did the job for cheque bounce. Where as she was working in the pvt ltd firm and i was the technical director along with 3 others. Issue was that i had never issued a cheque to that girl since I was not the signed authority of the company's cheque. Other two directors have signed that cheque which were bounced. I also paid my share of payment to that girl. Now she has filed against the case only to the company which was mine as sole proprietor and to that company where she did work and also mentioned me in that cheque bounce case. She totally trying to cheat me. Please give me the exact solution. Since total case is of 45000 and I paid her 18000 as of my share. How should I prove her wrong?
Sir if you have not signed the cheque. Then your liability is zero. The law is very well settled that only the signatory to the cheque is liable in a complaint case under section 138 negotiable instruments act. If you have not signed the cheque then you should file a quashing of complaint as regards your name under section 482 of code of criminal procedure in the high court.
