Execution of warrants against an accused in cheque bouncing cases

28-Sep-2023 (In Cheque Bounce Law)
In cheque bouncing cases multiple NBWs & BWs are issued against an accused. Accused stays in jurisdiction of court and very well comes home for food and sleep. His wife, father have his cell no and are very well aware of his location, where ever he has been hiding. But his family members are not co-operating with the police and are reluctant to reveal his hide outs. In law what provisions do the police have in terms of taking an action against the family members and forcing them to reveal the accused's hide outs.

There is no provision to compel the family to reveal the location of the accused as it is a private case and not a state case. Secondly, if his whereabouts are unknown after issuance of nbw, you can file an application in court asking for order of proclamation agains the accused.

If a NBW has been issued against you, leave your home immediately. You can be arrested or even put in judicial custody if you dont get bail. Then, through an attorney, apply for anticipatory bond with the court. Do not hesitate to hire a lawyer who will represent you at court.

How long is a NBW valid for?

As long as the NBW is not executed, there is no time limit on its validity. The NBW can remain in effect until the arrest of the person or until a court orders its retraction.

How can NBW be Cancelled?

It is necessary to apply for the cancellation of a warrant that cannot be bailed out under Section 138 (Negotiable Instruments Act, 1881). 11-May-2023

step 1 satisfy the judge with the facts and pray to declare him proclaimed offender and also move an application to attach his property but it must be clear that the property to be attached is self acquired by the accused
