Delay to issue notice after cheque bounced

No sec 5 limitations act benefits if you delay in sent notice within a month of recieving of bank memo. But if you delay for send in notice than you can present that check in bank again. After that u getting full limitations. For more information you can call me

Question of limitation is already specified under NI act inder section 142 hence limitation act is not applicable here the bearer should send a notice through advocate at the earliest possible date of knowledge

You cant not invoke section 5 of limitation act as this section is of civil in nature, while 138 proceedings are criminal in nature. provide the details of boincing of cheque, and for further assistance please contact

ye,s you can get the delay condoned by giving sufficient cause of not presenting the matter within the prescribed period under Sub clause 2 of Section 142 of N.I.Act. you are required to move application for condonation of delay along with complaint under Section 138 N.I.Act
