Consequences of getting my cheque bounced
14-Jun-2023 (In Cheque Bounce Law)
Sir I had taken a loan of 200000 from my relative for which I had given 2 cheques of 100000 each as security. I returned the cash to them and they refused to give the cheque and they have presented the cheque and it got bounced now what to do?
Did your relative send you any notice stating that the cheques were returned? As soon as he sends a notice to you, you must send a reply within 15 days stating that you have repaid your loan and that the cheques were given by you only as a security. For any further clarifications kindly contact me.
Do you have any proof regarding repayment of loan, if it is, then don't worry, if they file case you can take defense on this. Any way send a legal notice stating the loan amount was repaid, so return the cheque. If they were not return it, file a private complaint against them. after presenting the cheque if they issued a noticed, give proper reply
the notice u/s 138 of nia will be issued by the opposite side. the person has to make arrangement of money for repayment properly. the reply to the notice has to be sent to defend the case in details.
