Clarification regarding an ongoing cheque bounce matter

14-Apr-2023 (In Cheque Bounce Law)
1.) Can a party still bounce the cheques everyday even after case is going on in the court? 2.) What is the detailed process of delivering bailable warrant if the case is of inter state but of high amount? 3.) If party is unavailable while delivering warrants, can their family be taken into custody?

A cheque once dishonored can be represent only once and not again and again. In your case the Bailable Warrant shall be executed by two police stations i.e. the concerned police station having Jurisdiction where the case is file and the other is the police station where the accused is residing.
If the party is unavailable then their family members cannot be taken into custody.
I have handled similar cases before. I advice you to also file a civil suit as the amount is huge. Book a consultancy call i will provide you with some specific detailed advice and a line of action to recover your money.

Your first question does not appear to be genuine for the reason the no fool will accept cheques from a person who is already facing charges of offence under section 138 of NI Act.
As far as delivering of Warrant is concerned, Cheque amount is not material. The warrant at the first instance needs to be issued to the local police station who in turn need to approach the police under whose jurisdiction the Accused is residing and has to be served upon the accused only and no family member can be taken into custody.
