Clarification on grounds for dismissal of case on grounds of delay

The cheque bounce case filed with eight days of delay.The JM who tried the case adjourned the case for 8 times,taken three to four months time.In all the hearing the complaintant attended the court.But the JM has dismissed the case.The opposition lawyer has made only made one attempt to say the case was filed after the delay of eight days.The complaintnant lawyer explained the court for the delay in filing the case.still the case was dismissed. what is the next course of action required to be done.
it should be moved to the session court with the remarks of jm court. in practical mode the session will not admit the case after a lapse of 8 years delay for which a direction from the high court has to be oobatined
