cheque returned for signature mismatch. Can we take them to court?

we have been engaged as installation contract by a Bangalore Firm and we have billed them to the tune of 4.3 lakhs, they have issued cheque dated 02/09/2015 for Rs.40000/- which returned for signature mismatch and since then we are following for payment but no response. can we take them to court

Hi, with in 30 days of the dishonour of the cheque you have to issue a legal notice to them and thereafter you have to file a complaint under section 138 of the Negotiable Instrument Act before the Magistrate.
