Dear Sir
The law says penaly may be imposed upto double the amount of cheque face value
But in practice Courts are giving only upto 20% of face value towards interest etc. However after filing case he has to deposit 20 percent of cheque amount if he wish to contest. It seems your cheque may be expired. You can immediately or you can file civil case upto 3 years. Please come.

The law on cheque bounce is transparent and time-bound.

If you have issued the cheque and it has bounced, and if you have received the legal notice, it would be better to negotiate with the person regarding the payment and settle it before it goes to Court. If a case is filed for cheque bounce, you might need to get a bail as an arrest warrant might be issued against you.

If you have received the cheque that bounced, then you have to get a legal notice issued within 30 days from receiving the endorsement from the Bank and follow other procedures laid down under the Negotiable Instruments Act.
