Cheque dishonored in joint account

Dear Sir,                      The cheque is issued to a joint A/C by a buyer. It is being operated jointly by 2 partners. One partner has filed a suit under sec 138 NI act without consuting other partner..My point is can he act unilaterally and file the case without consulting other partner

as per the partnership act and the partnership deed please read the terms of the partnership deed..
partnership deed should contain the details of the consultation of one partner to the other in case of any legal issue arises..

In a partnership firm the Parteners are jointly and severally liable for the acts of other. One partner can file complaint under the negotiate instruments act unless and until their is dispute between them on the share of the claim amount. The partnership works upon confidence between both the partner acts of one partner can be ratified by the other later on.
