Cheque deposited in wrong bank cheque got bounced
18-Feb-2023 (In Cheque Bounce Law)
Deposited the cheque of kotak mahindra bank to Bank of India Naubatpur (patna) on 2 jan while Validity of cheque was till 12 jan.Bank was unable to clear it & returning me the bounced cheque and stating the reason "Instrument outdated" .What to do in this situation?
The best course of action would be to ask payer to issue a fresh cheque since this cheque was a valid cheque and could not be honoured since the same was presented at a wrong bank. Further no action lies under section 138 of the Negotiable Instrument Act since the cheque was valid.
