Can I claim my money under both civil and Negotiable Instrument Act. Under the Negotiable Act I have received my money and my civil suit is pending. The party has deposited my money in the case under negotiable act and the court has decreed to withdraw the money which I have done.
You cannot receive your due amount once under criminal case and again under civil case. If you had opted only punishment for the accused under criminal case , you would have been justified in claiming your due amount under civil case. Once you have received your amount in criminal case, be satisfied with that
