Cheque bounced now can i re submit it since 3 months lapsed what to do

Cheque has been submitted once and it has been bounced. Now to resubmit it again there is no validity of cheque. Three months lapsed. can i initiate legal proceedings or can i resubmit the same cheque. confused how to handle.

you can present your cheque as many times as you want during the validity of the cheque. the validity of a cheque is 3 months from the date of the cheque. you can initiate but chance are very less, its like almost equal to 'No'. if its with 3 month you can presentation of cheque, if the cheque is again dishonored, you can send a Legal Notice to the drawer of the cheque within 30 days of such dishonour and if within the next 15 days after the receipt of such notice by the drawer of the cheque, the cheque amount is not made available to you, you have next 30 days to file a case in the Court in accordance with the provisions of Section 138 of Negotiable Instruments Act, 1881.

You ought to issue a legal notice to the party within one month from the date of return of cheque giving him 15 days time to pay the cheque amount. If he does not, you need to file cheque bounce case within one month from the date of lapse of 15 days time. Now, you cannot re-present the cheque for encashment.
