Cheque Bounced By One of known person, I already paid the amount.

I have one issue that Before 1-2 years I have received a sum of Rs. 1080000 by one of my known and given cheques in my and my sister's name. I have given him Rs. 850K by selling my shop.For rest amount taken 2 months time. In july, I had given Rs. 1 lakh+Sep. 1 lakh paid. In sept. when I gone to rest amount Rs. 30K. he demanded Intt. For whole amount, I already paid. I denied for that. He refused for taking rs. 30K and not returned the cheques. And now he bounced check and send me court summon.

do not be worried about the interest.

lender can only claim the amount due which was agreed upon between the parties.

if the lender files a case in which the amount shown is greater than amount due, the entire case gets dismissed.

If you have already received the summons from the court then you must appear on the next date of hearing and you also need to write down all the evidence that is in your favour and submit it in the form of a written statement. For more legal assistance I am just a call away.

Okay you can take a step as legal procedure as per law and put your defence before the court and don’t avoid the summon of the court. If you had already been entire payment against the alleged cheque then you are not liable to the same if you need any legal assistance you can call us

You need to hire expert advocate for your bail followed by 145(2) for cross examination.

We should immediately appear before the court and apprise the court about filing of a frivolous case against you. Simultaneously, we should also file a complaint against him for using your cheques unlawfully for defending our case better
