Cheque Bounce - Legal Notice Sending Fees

Need to know how to proceed with Legal notice as cheque got bounced provided by one person to me .Need to know how much fees involved for sending notice and in how much time takes to get justice on same

In usual course, you have to send the statutory notice within 10 days of receipt of the Inward Memo received from bank towards dishonour of cheque. 15 days time is to be given in notice. Thereafter within 30 days you will have to file a case u/s. 138. After issuance of summons, the other side has to deposit a partial sum of money in court. There are chances that he would settle it on the first date in court.

It is mandatory to issue legal notice after cheque had been dishonored. You have to issue legal notice within thirty days from the date of receiving memo from Bank. After that you will have to wait for next fifteen days for filing case.

To send a legal notice under the provisions of negotiable instruments act the professional fee for issuing a legal notice shall be rupees five thousand only and to get justice you may require to file a compliant failing which you may not get justice at all
